Hagberg; xi & 178 pp. Ithaca: Cornell University Press, 1994, $27.50.The idea of studying Henry James and the later Ludwig Wittgenstein together is attractive, although there is very little stylistic similarity between them. Wittgenstein writes like a novelist, James like a philosopher. Wittgenstein is intensely interested in (...) the real language of real people; most of James’s dialogues bristle with a peculiarly Jamesian stiltedness. But both writers focus on the exquisite, extensive subtleties of language and of linguistic interaction, subtleties that tend to make uselessly crude such notional entities as facts, meanings, or ideas, and so of an epistemology based on such entities. The extremely fine grain of James’s analyses of his characters and of their analyses of each other already commits him philosophically to agreeing with Wittgenstein’s central insight that “to imagine a language means to imagine a form of life”: to James’s characters life consists in interpretation of each other’s language. Those characters have the deepest lives who come to the greatest subtlety in their investigations of what determines the deeply overdetermined linguistic moves made by other minds.Hagberg’s book is disappointing, however. The exposition of Wittgenstein is unexceptionable but hardly novel, and as for James, Hagberg has confined himself to four stories, considerable to be sure, but hardly the novels. Hagberg gives creditable readings of these stories, especially “The Lesson of the Master” and “The Figure in the Carpet.” But he treats James’s stories more as demonstrations of his philosophical point—that there is an analogy between language games and works of art, also an analogy between our attitude towards a person and our attitude towards a work of art—than as works of art themselves. This would be fine if he didn’t keep asserting that they are examples of what they address: perhaps they are, but Hagberg makes them out primarily as didactic. Thus in “Figure” he finds a clear and direct argument that one ought not look for some propositional content as the point or secret of a work of art and thus a fortiori of a story like the one under consideration. [End Page 373] Hagberg is right, of course, but he reduces the story to a moral in just the way he claims it warns us to avoid.In his treatment of “Lesson,” he writes with real insight about the ambiguities of the master’s motivation in that story, and argues convincingly that the motivation may be opaque to the master himself, but then retreats from the insight thus won by treating ambiguity itself rather literal-mindedly, as a sort of resultant of several unambiguous vectors. Although the comparison of ambiguity to seeing aspects is fascinating, Hagberg’s analysis would be inevitably enriched by treating The Golden Bowl, where Adam Verver remains essentially ambiguous. Hagberg’s readings falter because his sense of language-games is too flat: he doesn’t take into account (although he claims to) their genuine variety. For Hagberg, unlike for Wittgenstein, games always have well-defined moves, and so ambiguity becomes a move. But what if it’s ambiguous whether it’s a move or not?Perhaps Hagberg’s account of “The Tree of Knowledge” is least in the spirit of Wittgenstein. In Philosophical Investigations Wittgenstein writes, “I can know what someone else is thinking, not what I am thinking” (Part II, section xi). But Hagberg, in a taxonomy of kinds of knowing, takes it for granted that I can know what I am thinking (pp. 153, 169): again, this is a way of reducing ambiguity to a question of the intent of a “move,” and not grappling with its fundamental elusiveness.Meaning and Interpretation is a learned and helpfully provocative book, often written with great verve, but its value is more in the questions that it broaches than in the answers it offers. In William Angoff's recent article in Theoretical and Philosophical Psychology, he presented several thought-provoking philosophical issues of concern to measurement-oriented psychologists. The first of these issues, the notion of test and item bias, is the topic of the present paper. In his article, he reports that average score differences in the performance on many cognitive tests have appeared among racial or ethnic groups. Twenty to thirty years ago, differential psychologists, summarizing and critically evaluating studies demonstrating performance differences on tests (...) and in other behavior among cultural, ethnic and racial groups, agreed that such group differences indeed existed, but that causal interpretations differed markedly among the investigators at the time. More recently, the focus has shifted to what has been termed test fairness, with the focus falling more upon tests and their inadequacies than the behavior which underlies the tests. Similar findings and conclusions were frequently advanced in physiological tests of strength and endurance which are often used for civil service positions such as those in the fire fighting service and which frequently disadvantage women. The question raised is simply whether the discrimination is fair or not; that is, do given test score differences reflect variation in performance between groups which are reflective of true behavioral differences or are these differences artifactual and embedded in the assessment device itself, whether intentional or not. 2012 APA, all rights reserved). Myershenning offers a most significant work that deals with fundamental yet neglected subjects in Dewey's philosophy, and she challenges much of the cognitive and linguistic efforts to recast pragmatism as part of the epistemology industry. She does all of this by asking questions that we have not really engaged before.Henning's central argument is that Dewey's theory of mind offers an implicit theory of the unconscious, one that (...) has more in common with psychodynamic understandings of the self than with the cognitive-behaviorism that has become the dominant model for the American mind. This kinship between Dewey and psychodynamic perspectives is found in its rejection of atomistic experience and its emphasis on the felt dimensions of experience. Although the recent revival of interest in Dewey has most often linked him with a more linguistic pragmatism and epistemology, Henning moves away from that trend to re-engage with Dewey's "cultural naturalism," returns to the question of what Dewey means by "experience," and advocates for the value of the non-linguistic, non-cognitive portion therein.It is through Dewey's theory of quality that Henning finds a clear connection to the unconscious. Dewey holds that we live in a qualitative world, that we experience the world as affectively charged, and he claims that things come together only insofar as they are pervaded by a single unifying quality. The process of knowing anything begins first in an immediate, sensuous, and affective experience, a dimension that eludes linguistic symbols. That is, there is an ineffable portion of experience that supports our discursive practices and can never be exhausted by them. Henning holds that insofar as qualities resist language and are immediately and sensuously available, there is also a sense in which they guide and form experience unconsciously. In _The __Critical Advantage_, noted scholar and early childhood expert William T. Gormley, Jr. takes a wide-ranging look at the important role of critical thinking in preparing students for college, careers, and civic life. Drawing on research from psychology, philosophy, business, political science, neuroscience, and other disciplines, he offers a contemporary definition of critical thinking and its relationship to other forms of thinking, including creative thinking and problem solving. When defined broadly and taught early, he argues, critical thinking is (...) a “potential cure for some of the biggest problems we face as a nation,” including education deficits, employment deficits, and the recent surge of partisanship in democratic politics. While there are encouraging signs—the Common Core State Standards have drawn attention to the importance of critical thinking—recent efforts have been too narrowly focused on improving textual analysis in high school. Those who might benefit the most from curricula prioritizing critical thinking, including disadvantaged students, are less likely to be represented in courses and other activities that encourage this skill. Gormley argues for prioritizing critical thinking skills in PreK–12. He takes readers into innovative classrooms around the country, including schools in Pennsylvania, Oklahoma, and Virginia, and offers specific recommendations for promoting critical thinking and embedding it across the curriculum. _The Critical Advantage_ is an insightful and fascinating account of an intellectual journey culminating in a fresh vision for the future of US schooling. This article is part of a Symposium that examines the legal and policy issues raised by the Schwarzenegger bobblehead doll litigation, in which a Hollywood star-turned-governor sued under California's right of publicity laws and under federal copyright law to stop a small Ohio company from selling a bobblehead doll depicting Schwarzenegger in a business suit, with a bandolier of bullets, and brandishing an assault rifle. The article contends that defendants' unauthorized use of the Schwarzenegger image on dolls and their accompanying (...) packaging was permissible as First Amendment-protected free speech under California's right of publicity laws and also constituted fair use under federal copyright law. The article rejects the argument that a First Amendment defense to plaintiff's right of publicity claims was unavailable because a bobblehead doll is not a "traditional" medium of expression for ideas. The article recognizes that overly expansive assertions of rights of publicity and other intellectual property rights threaten to stifle creative expression and diminish the cultural commons. The article also calls for clearer and more consistent recognition of defenses to right of publicity claims, particularly for cases where a defendant's unauthorized appropriation of another's image or likeness is for purposes of caricature, parody, or satire¿especially where the image is that of a politician. It concludes that the settlement of the Schwarzenegger bobblehead doll case illustrates how "strategic" assertions of even objectively non-meritorious rights of publicity can allow powerful plaintiffs to censor unflattering depictions of them and to unduly expand intellectual property rights without full adjudication on the merits of such claims.This insight is critical, because while other scholars have suggested that the "over-protection" of intellectual property rights (including rights of publicity) has a deleterious effect on freedom of expression and the public domain, these criticisms focus almost exclusively on published appellate cases. Yet, as this article reminds us, most cases settle and never become litigated cases, much less published appellate decisions. And most disputes - including intellectual property disputes - never result in formal litigation in the first instance. As with most other areas of the civil disputing process, intellectual property disputes are processed in the "shadow of the law", where repeat players have strategic advantages to shape the outcomes of disputes in their favor. Thus, if we want to know whether intellectual property rights are over-protected, we need to know what happens (and why) in the shadow of intellectual property law. This insight is the basis for the author's empirical research-in-progress focusing on "strategic intellectual property enforcement" by owners of trademarks, copyrights, and patents, including enforcement that never results in litigation and is thus under the radar of what most legal scholars in this area of law examine. Since our visual perception of physical things essentially involves our identifying objects by their colours, any theory of visual perception must contain some account of the colours of things. The central problem with colour has to do with relating our normal, everyday colour perceptions to what science, i.e. physics, teaches us about physical objects and their qualities. Although we perceive colours as categorical surface properties of things, colour perceptions are explained by introducing physical properties like reflectance profiles or dispositions to (...) cause certain experiences in normal human perceivers. Hence, it seems as if colours as they are experienced by us have no place in the physical world, because they are fundamentally different from the properties which we ascribe to physical objects in scientific accounts of colour perceptions.
